This End User Agreement (the "Agreement") is a legally binding contract between you (the "User") and Chambre, LLC (the "Company," "we," "us," or "our"), the owner and operator of the OctoGoldPicks prediction platform (the "Platform" or "System"). By accessing, subscribing to, or using the Platform, you agree to be bound by the terms and conditions set forth below.
Please read this Agreement carefully. It contains important disclaimers, limitations of liability, and conditions regarding your use of the Platform.
1.1 No Financial Responsibility
Chambre, LLC expressly disclaims any and all financial responsibility arising from your use of the Platform. Our recommendations and predictions are based solely upon our proprietary system, and we provide no representations or warranties other than those explicitly stated within this Agreement.
1.2 Not Financial Advisors
Chambre, LLC and its owners are not licensed by any securities exchange commission or regulated by any financial institution. Chambre, LLC does not hold itself out to be a financial advisor, nor does it provide professional financial advice.
The User acknowledges that the information received consists solely of predictions generated by Chambre's proprietary system embodied within the OctoGoldPicks Platform. There are no representations or warranties other than those given by this licensing agreement.
1.3 Service Availability and Force Majeure
The Platform provides no representations or warranties regarding uninterrupted access. The site may be unavailable due to technical issues, environmental factors, disaster situations, or acts of God. Chambre, LLC shall not be liable for any downtime or unavailability under such circumstances.
2.1 The 50% Success Guarantee
Our guarantee is strictly limited to a success rate of above 50% for our "pick to click" recommendations. This guarantee is subject to the following definitions, restrictions, and limitations:
- Eligibility: The guarantee applies only to a given whole month that is paid in full by the User. Partially paid months, free offers, discounts, and other promotional services do not qualify as a full month and are not subject to this guarantee.
- Refund Conditions: If a User has paid for a full month and the Platform's success rate is less than 50% of the days in that month (e.g., 13 to 15 days of success), the User is entitled to a full monthly refund.
- Fulfilled Guarantee: If the Platform is successful with its "pick to click" recommendations for more than half of the days in a month (e.g., 15 to 16 days of success in a 30-day month), the guarantee requirement has been fulfilled, and the User is not eligible for a refund.
2.2 Payment and Access
Once any premium or coupon has been used, the User is entitled to use the OctoGoldPicks System according to the payment received and properly processed by the Company. If a payment cannot be processed for any reason, the User will not have eligible access to the System.
Access to OctoGoldPicks may be revoked at any time. If access is revoked and the User has not violated any terms herein, the User may be subject to a partial monthly or yearly discount or refund.
3.1 Prohibition on Information Sharing
The sharing of information obtained from the OctoGoldPicks Platform is strictly prohibited. All information provided through the Platform is for the User's personal use only, under the purview of the User's specific access granted by the Platform.
4.1 No Relationship with Polymarket Companies
It is expressly understood that the OctoGoldPicks Platform has no relationship with any polymarket company or service. While the Platform may provide a courtesy link to certain services, Chambre, LLC has no formal business relationship with these entities whatsoever.
Chambre, LLC makes no representations or warranties about the quality or terms of engagement for these third-party services and expressly denies any liability arising from actions regarding the User and other polymarket services.
4.2 Jurisdictional Bans
In some instances, the services provided by the OctoGoldPicks Platform may be banned in certain jurisdictions. Chambre, LLC takes no responsibility if a User chooses to engage with the Platform from such jurisdictions. The User understands and agrees that access to OctoGoldPicks could be turned off at any time by the Service or via a request from a given jurisdiction.
5.1 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States, as well as applicable international laws, without regard to conflict of law principles.
5.2 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to this Agreement or the use of the OctoGoldPicks Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the parties agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association.
5.3 Limitation of Liability
To the fullest extent permitted by applicable law, Chambre, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with this Agreement or the use of the Platform.
5.4 Indemnification
The User agrees to indemnify, defend, and hold harmless Chambre, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with the User's access to or use of the Platform, or the User's violation of this Agreement.
5.5 Severability
If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable.
5.6 Entire Agreement
This Agreement constitutes the entire agreement between the User and Chambre, LLC with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
5.7 Amendments
Chambre, LLC reserves the right, at its sole discretion, to modify or replace this Agreement at any time. Users will be notified of material changes. Continued use of the Platform after any such changes constitutes your acceptance of the revised Agreement.
5.8 Waiver
The failure of Chambre, LLC to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
Acknowledgment of Agreement
By subscribing to or using the OctoGoldPicks Prediction Platform, you acknowledge that you have read, understood, and agree to be bound by this End User Agreement.
